GDPR claims for damages in German courts: current trends and implications for companies - Webinar on May 6th, 2024

GDPR claims for damages are keeping various German courts very busy. To provide an example: according to a press release issued by the Higher Regional Court of Stuttgart in November 2023, over 100 claims for damages under Art. 82 GDPR against Meta are pending before one civil senate of the Higher Regional Court alone - there are said to be more than 6,000 proceedings against Meta nationwide. At the same time, latest decisions from the European Court of Justice will likely influence future decisions of German courts.
German GDPR specialists are blessed (and maybe also somewhat cursed) with a high number of publicly available judgments dealing with claims for damages under the GDPR. This is at least partially caused by specialized providers offering consumers the opportunity to bring claims for damages under Art. 82 GDPR on their behalf against companies which have suffered publicly reported potential data breaches or IT security incidents. Also in the employment context, employees seem to tend to claim damages under the GDPR more often. There are probably now hundreds of decisions in Germany on various aspects of the claim for damages under Art. 82 GDPR.
In our webinar, we will provide you an overview on current trends and explain you the reasons why claims brought forward succeeded or failed. In addition, we will have a look at possibilities of controllers and processors to defend themselves against such claims and provide insights into our own experiences.
